Terms of Sale

General terms of sale applying to products (shop) and services (lessons, workshops, talks) offered on this site.

This page is provided in English for convenience. The French version is the legally binding original, and this site is governed by French law.

Article 1 — Purpose

These general terms of sale govern the contractual relationship between the association L'Art et la Manière (Gilles Aguilera) and any person purchasing a product (shop) or booking a service (private lesson, workshop, talk) through this site.

Article 2 — Products and services

Products offered in the shop (brushes, pigments, including Tyrian purple) are described as accurately as possible. Teaching services (video-call lessons, in-studio lessons, group workshops, talks and demonstrations) are described on the Lessons & Workshops page, along with indicative pricing.

Article 3 — Price and payment

Prices are shown in euros, inclusive of all taxes where applicable. Payment is made exclusively via PayPal, under that provider's own terms. An order or booking is considered final only once payment has been confirmed.

Article 4 — Booking lessons and workshops

Private lessons, workshops and talks are booked through the online calendar (Cal.com) presented on the Lessons & Workshops page. Any booking implies acceptance of these general terms.

Article 5 — Delivery of products

Shop products are shipped within a reasonable time after payment is confirmed, to the address provided by the buyer. Delivery costs and terms are specified at the time of order.

Article 6 — Right of withdrawal

In accordance with the French Consumer Code, any buyer has 14 days from receipt of the product to exercise their right of withdrawal, without having to give a reason. This right does not apply to lesson or workshop services that have been fully performed before the end of the withdrawal period, with the client's express agreement.

Article 7 — Cancelling lessons and workshops

Any cancellation of a lesson or workshop should be notified as early as possible. Refund or rescheduling terms will be considered on a case-by-case basis, depending on the notice given.

Article 8 — Liability

The association L'Art et la Manière undertakes to take the greatest care in describing and delivering its products and services, but cannot be held liable for damages resulting from improper use of the products sold.

Article 9 — Governing law and disputes

These terms of sale are governed by French law. In the event of a dispute, an amicable solution will be sought first; failing that, the French courts shall have exclusive jurisdiction.
